Kilty Property: Review of Phase II Environmental Study Cost and Timeframe
Assistant Corporation Counsel Rich Gentile initiated a discussion regarding his recent interaction with Fuss & O’Neil relevant to further environmental testing on the Kilty Property subsequent to the Phase I study that has already been completed. The recommended testing would take approximately 3-4 weeks and would cost approximately $4,600.000 to complete. Because the cost is under $5,000.00 the Committee can act without needing to return to the Town Council for approval. Attorney Gentile also opined that the 3-4 week timeframe for completion of the testing will not detrimentally affect the sale process.

to authorize the Administration to proceed with Phase II
testing of the Kilty Property commensurate with the letter to
Assistant Corporation Counsel Richard Gentile from Fuss & O’Neil
dated May 18, 2009.
